Terms of Use

These Terms of Use are an agreement between you and H Wang, an individual based in Ontario, Canada ("GyroGolf", "we", "us"). They cover your use of the GyroGolf app for phones and smart watches, listed on the App Store as "GyroGolf: Swing & Putt" (the "App"), the GyroGolf Pro subscription, and this website, gyrogolf.com (the "Site").

By using GyroGolf, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use GyroGolf.

Your licence to the App

The App is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the "Apple EULA"). In the App, "Terms of Use" opens the Apple EULA. These Terms add to it. If these Terms conflict with the Apple EULA, the Apple EULA wins. The Apple EULA's own governing-law clause applies to the Apple EULA; the "Governing law" section below applies to these Terms.

These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its support.

Who can use GyroGolf

You must be at least 13 years old to use GyroGolf. If you're under the age of majority where you live, a parent or guardian must agree to these Terms for you.

What GyroGolf is

GyroGolf records your swing or putt with the motion sensors in your smart watch, and shows it on your phone: your tempo, your wrist action, and your swing in 3D. You need a smart watch running watchOS 10 or later and a phone running iOS 18 or later.

GyroGolf measures your wrist, not your club. Every number it shows is worked out from your watch's sensors and is an estimate. Hand speed is the speed of the watch on your wrist, not your clubhead. GyroGolf doesn't measure clubhead speed, clubface angle or ball flight, and it doesn't promise that your game will improve.

Play safely

GyroGolf is a practice tool, not medical advice, and not a substitute for a qualified coach. Make sure you have room to swing and that no one is near you. Wear your watch securely. Stop if you feel pain, and talk to a doctor before you start a new exercise routine. You use GyroGolf at your own risk.

GyroGolf Pro subscriptions

The phone app's features, including Tempo, Wrist action and the 3D swing and putt views, need GyroGolf Pro, a subscription sold through Apple's App Store. The smart watch app records without a subscription.

  • Plans: GyroGolf Pro comes as a monthly or a yearly subscription. The App Store shows the current price in your currency before you buy.
  • Free trial: new subscribers may get a free trial (currently 1 month). Apple decides who is eligible. To avoid being charged, cancel at least 24 hours before the trial ends. Otherwise your subscription starts and you're charged.
  • Payment: payment is charged to your Apple Account when you confirm your purchase, or at the end of your free trial.
  • Automatic renewal: your subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Apple charges for the renewal within the 24 hours before the current period ends.
  • Cancelling: manage or cancel your subscription in your phone's Settings, under your name, then Subscriptions, or with Manage Subscription in the App's Profile. Cancelling stops the next renewal. You keep GyroGolf Pro until the end of the current period, including a free trial.
  • Refunds: Apple handles all payments and refunds under its own policies. You can request a refund from Apple at reportaproblem.apple.com. If you're in the EU or the UK, Apple's terms also give you 14 days to cancel a purchase.
  • Price changes: if the price of your subscription changes, Apple will tell you in advance and, where required, ask for your consent, as Apple's rules require.
  • Family Sharing: GyroGolf Pro can't be shared through Family Sharing.

Your recordings

Your captures are yours. They're stored on your own devices, and we don't receive them (see our Privacy Policy). You're responsible for keeping your devices and backups. Deleting the App, or a capture, may remove captures permanently.

Using GyroGolf properly

Don't misuse GyroGolf. In particular, don't:

  • copy, modify, or reverse-engineer the App or the Site, except as the law allows;
  • interfere with the Site or try to get around its security;
  • use GyroGolf to break any law.

Our rights

GyroGolf, the App, the Site, and their content, designs and trademarks belong to us or our licensors. These Terms don't give you any rights in them except your licence to use the App and to view the Site.

If you send us ideas or feedback, we may use them freely and without paying you.

Third parties

GyroGolf relies on Apple's devices, App Store, HealthKit and other services. Apple's own terms and policies govern your use of them. You must also follow any third-party terms that apply to you, such as your wireless carrier's.

No warranty

We work hard to make GyroGolf accurate and reliable, but we provide it "as is" and "as available". To the extent the law allows, we make no other warranties, express or implied, including that GyroGolf will be uninterrupted, error-free, or fit for a particular purpose. Apple has no warranty obligation for the App, except as the Apple EULA says.

Limits on our liability

To the extent the law allows:

  • We aren't liable for indirect, incidental, special or consequential losses, including lost data, arising from your use of GyroGolf.
  • Our total liability to you for all claims about GyroGolf is limited to the greater of: the amount you paid for GyroGolf Pro in the 12 months before the claim, and fifty dollars ($50).
  • These limits don't apply to liability for personal injury where the law doesn't allow them to.

Nothing in these Terms limits any rights you have under consumer-protection laws that can't be waived, including Ontario's Consumer Protection Act, 2002.

Ending these Terms

You can stop using GyroGolf at any time by deleting the App; cancel any subscription in your phone's Settings. If you seriously break these Terms, your licence to use the App ends. The sections on our rights, the warranty, liability and governing law continue after these Terms end.

Changes to these Terms

We may update these Terms. When we do, we'll change the version and effective date at the top of this page. If a change is significant, we'll also give notice on the Site or in the App before it takes effect. If you keep using GyroGolf after a change takes effect, you accept the new Terms.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute. If you're a consumer living elsewhere, you also keep the protection of the mandatory laws where you live.
